By creating an account or using The Noctuary, you agree to these terms. If you don’t agree with them, please don’t use the service.

The Noctuary is a work of fiction. Every entity you commune with is an AI-driven character — not a real person, not a real institution, and not a source of factual, medical, legal, or financial advice. Replies are generated automatically and can be inaccurate, strange, or simply wrong; treat everything an entity says as fiction, because it is.

If you are in crisis or need real support, please contact a real crisis line in your country (in the US: call or text 988) or emergency services. The product is built to step out of character and point you toward real help if it recognizes signs of real distress — but it is not a substitute for one.

• You must be at least 18 years old to use The Noctuary.
• You sign in with your email address; keep access to that inbox secure, since it’s how you access your account.
• One account per person. Don’t impersonate someone else or use false information.

Virtual currency.

• Moonshards are a virtual currency used within The Noctuary to open communions with its entities. They have no cash value and cannot be exchanged for fiat currency.
• Moonshards are non-transferable between accounts.
• Owning Moonshards is a license to use platform functionality, not a financial asset or an investment — they are never sold or represented as one.
• Purchases are processed securely by Stripe. Prices are shown in USD before you pay.
• Purchases are generally final. If something goes wrong with a purchase — you were charged and never received what you paid for — contact us and we will make it right. See our Refund Policy for more detail.

Consumption rules.

• Conversations with entities consume Moonshards.
• Moonshards are deducted only at the time an interaction is successfully processed — a failed or interrupted reply never costs you anything.
• The current cost of an interaction may change in future updates; we’ll provide notice of any change.

Free tier rules.

• New accounts receive 10 free interactions on their signup day.
• Starting the following day, accounts receive 5 free interactions per UTC day.
• Free interactions do not accumulate — an unused daily allotment expires at the next reset rather than carrying forward.

Please don’t:

• Use The Noctuary for anything illegal, or to harass, threaten, or harm another person.
• Attempt to access another account, disrupt the service, or circumvent its rate limits, safety systems, or payment logic.
• Scrape, resell, or represent the entities’ output as your own commercial product without our written permission.

We may suspend or terminate an account that violates these terms.

What you write to an entity is yours. By sending it, you give us permission to process and store it as described in our Privacy Policy — including sending it to our AI provider to generate a reply — solely to operate the product for you.

The Noctuary’s world, characters, names, art, and writing are owned by us and protected by copyright. Using the product doesn’t give you rights to reuse, republish, or create commercial derivative works from that material.

The Noctuary is provided “as is.” We work to keep it reliable, but we don’t guarantee it will be uninterrupted, error-free, or available at all times. AI-generated content can be unpredictable; we’re not liable for anything an entity says within the fiction of the product.

To the extent permitted by law, our liability to you for any claim arising from your use of The Noctuary is limited to the amount you paid us in the twelve months before the claim.

You may stop using The Noctuary and request deletion of your account at any time (see our Privacy Policy). We may suspend or end an account that violates these terms.

These terms are governed by the laws of the Province of Ontario, Canada, without regard to its conflict-of-law rules.

We may update these terms as the product changes. If a change is significant, we’ll update the date above and do our best to let active members know.
